Article 3 - Applicability

3.1 These terms apply to every offer we make and to every contract concluded between us and the customer.

3.2 Before the contract is concluded, the text of these terms is made available to you electronically in such a way that you can easily store it on a durable medium. The terms are also accessible at any time in the webshop.

3.3 If you are a consumer, nothing in these terms limits the rights you have under mandatory law, including the mandatory consumer law of the country where you live.

3.4 Where specific conditions for a product are stated on its product page, they also apply. In the event of a conflict, you as a consumer may rely on the provision that is most favourable to you.

3.5 If any provision of these terms is void or annulled, the remaining provisions remain in force. The provision concerned will be replaced by a valid provision that comes as close as possible to its purpose.

3.6 Unclear provisions are interpreted in the way most favourable to the consumer. Any general terms of the customer do not apply.

Article 4 - The offer

4.1 Our offer is without obligation and valid while stocks last. We may change or withdraw the offer at any time before a contract is concluded.

4.2 The offer contains a complete and accurate description of the products, sufficiently detailed to enable you to make a proper assessment. Images are a truthful representation; slight differences in colour or packaging may occur. Obvious mistakes or errors in the offer, such as an obvious pricing error, do not bind us.

4.3 Each offer states the price including VAT, the shipping costs, the payment method, the manner of delivery, whether the right of withdrawal applies, and the countries to which the product is not shipped.

4.4 Our products are offered only to adults (see Article 16) and only for delivery to destinations that are not excluded destinations.

Article 5 - The contract

5.1 You place an order by adding products to your cart, entering your details and date of birth, choosing a shipping method, checking your order, accepting these terms and confirming your order with the order button, which clearly indicates that placing the order involves an obligation to pay.

5.2 The contract is concluded when you place your order. We confirm receipt of your order by email without delay. As long as we have not confirmed receipt, you may dissolve the contract.

5.3 We may refuse or cancel an order, in whole or in part, stating the reasons, if: (a) the delivery address is an excluded destination for one or more of the products; (b) there are indications that you are under the minimum age, or you do not provide proof of age that we have requested; (c) we have not received your payment within the period set out in Article 14; (d) there is a reasonable suspicion of fraud, or of resale to minors or to excluded destinations; or (e) there is an obvious error in the price or product information. We refund any amount already paid for the cancelled products within 14 days.

5.4 We take appropriate technical and organisational measures to secure the electronic transfer of data and the webshop environment.

5.5 At the latest upon delivery, we send you a confirmation of the contract on a durable medium (by email). It includes our address for complaints, the conditions and procedure for exercising the right of withdrawal (or a clear statement that it does not apply), the model withdrawal form, the price including taxes, the shipping costs, and the information on payment and delivery.

5.6 The contract is concluded in English or Dutch, depending on the language version of the webshop you use. We store the details of your order; you can view them in My account.

Article 6 - Right of withdrawal

6.1 As a consumer, you can withdraw from the contract without giving any reason within a withdrawal period of 14 days. We may ask for the reason, but you are not obliged to give it.

6.2 The withdrawal period starts on the day after you, or a third party designated by you who is not the carrier, have received the product. If you have ordered several products in one order that are delivered separately, the period starts on the day after you have received the last product.

6.3 You may also withdraw from the contract before you have received the products.

6.4 The right of withdrawal does not apply to the products and situations described in Article 10.

Article 7 - Your obligations during the withdrawal period

7.1 During the withdrawal period, you must handle the product and its packaging with care. You may only unpack or use the product to the extent necessary to establish its nature, characteristics and functioning, in the same way as you would be allowed to in a shop.

7.2 You are liable for any diminished value of the product resulting from handling it beyond what is permitted in 7.1.

7.3 You are not liable for diminished value if we did not provide you with all the legally required information about the right of withdrawal before or at the time the contract was concluded.

Article 8 - Exercising the right of withdrawal and costs

8.1 To exercise your right of withdrawal, you must inform us of your decision within the withdrawal period, in one of these ways:

  • through the withdrawal function in the webshop, labelled "Withdraw from contract here";
  • by sending the model withdrawal form (Annex 1) by email to office@hhc-noids.com or by post to the address in Article 2; or
  • by any other unambiguous statement, by email, by post or through the contact form.

8.2 The withdrawal period has been respected if you send your statement before it expires. We confirm receipt of your withdrawal on a durable medium (by email) without delay.

8.3 You must send the product back to us, or hand it over to a person authorised by us, without undue delay and in any case within 14 days after the day on which you informed us of your withdrawal. Unless we give you a different return address, return the product to the address in Article 2. The deadline is met if you send the product back before the 14 days have expired.

8.4 Return the product with all accessories supplied and, where reasonably possible, in its original condition and packaging, following any reasonable and clear instructions we give.

8.5 The risk and the burden of proof for the correct and timely exercise of the right of withdrawal lie with you. We recommend using a shipping method with tracking.

8.6 You bear the direct costs of returning the product.

Article 9 - Our obligations in the event of withdrawal

9.1 We refund all payments received from you, including the delivery costs charged for the returned products, without undue delay and in any case within 14 days after the day on which you informed us of your withdrawal. Unless we offer to collect the product ourselves, we may withhold the refund until we have received the product or until you have shown that you have sent it back, whichever is earlier.

9.2 We refund you using the same means of payment you used (bank transfer to the account from which you paid), unless you expressly agree to another method. The refund is free of charge for you.

9.3 If you chose a delivery method that is more expensive than the cheapest standard delivery we offer for your destination, we do not have to refund the additional costs of the more expensive method.

9.4 We may deduct from the refund any diminished value for which you are liable under Article 7.2.

Article 10 - Exclusion of the right of withdrawal

10.1 The right of withdrawal does not apply to:

  • sealed products that are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery. In our range this concerns in particular disposable vapes and 510 cartridges, e-liquids, distillates, terpenes and isolates, cosmetics, food products and pet products;
  • products that deteriorate or expire rapidly;
  • products that, after delivery, are by their nature inseparably mixed with other items.

10.2 These exceptions only apply if we have clearly stated them before the contract is concluded. Products whose seal is unbroken can be returned under the normal withdrawal rules.

10.3 The exclusion of the right of withdrawal does not affect your rights under the legal guarantee (Article 12) if a product is defective.

Article 11 - Price

11.1 All prices are in euros and include VAT. Shipping costs are shown separately before you place your order.

11.2 For deliveries within the Netherlands, prices include Dutch VAT (BTW) at 21% (standard rate) or 9% (food). For deliveries to other EU countries, VAT is charged in accordance with the EU VAT rules for distance sales. Deliveries outside the EU are made without VAT; any import duties and local taxes are payable by the customer.

11.3 The price stated at the time of your order applies. We do not change the price of a contract after it has been concluded.

11.4 Where we announce a price reduction, the previous price shown is the lowest price we applied during the 30 days before the reduction.

11.5 In the case of an obvious error in the price, we are not bound by the incorrect price. We will inform you; you can then cancel the order free of charge or confirm it at the correct price.

Article 12 - Conformity and legal guarantee

12.1 We guarantee that the products conform to the contract and to the specifications stated in the offer, that they meet reasonable requirements of soundness and usability, and that they comply with the statutory provisions in force in the Netherlands on the date the contract is concluded.

12.2 If a product does not conform to the contract, you as a consumer have the rights provided by law (Article 7:17 and following of the Dutch Civil Code): repair or replacement free of charge and, if that is not possible or not reasonable, a price reduction or termination of the contract. We bear the costs of returning defective products.

12.3 The legal guarantee has no fixed duration in the Netherlands: it depends on what you may reasonably expect from the product. For consumables, this is linked to their nature; for example, a disposable vape is expected to work until its contents are used up.

12.4 If a defect appears within one year after delivery, it is presumed to have existed at the time of delivery, unless we prove otherwise.

12.5 Please notify us of a defect within a reasonable time after you have discovered it. A notification within two months after discovery is always in time. Include your order reference, a description and, if possible, photos.

12.6 The legal guarantee does not cover defects caused by improper use, by use contrary to the instructions or warnings, by modifications, or by accidents after delivery.

12.7 We do not offer a separate commercial guarantee unless this is stated on the product page. A manufacturer's guarantee is an addition to, and never a limitation of, your rights under the legal guarantee. The EU harmonised notice on the legal guarantee of conformity is also displayed in the webshop.

Article 13 - Delivery and execution

13.1 We take the greatest possible care when receiving and executing orders. We deliver to the address you have given us.

13.2 We ship within 1-2 working days after receiving your payment. The delivery times on the Shipping & delivery page and in the checkout are estimates. We deliver without undue delay and in any case within 30 days after receiving your payment, unless a longer delivery time applies to the shipping method you have chosen.

13.3 If delivery is delayed, or if an order can only be executed in part or not at all, we will inform you no later than 30 days after you placed the order. You then have the right to dissolve the contract free of charge, as well as any right to compensation you may have under the law. We refund any payment within 14 days after dissolution.

13.4 The risk of loss of and damage to the products remains with us until they have been delivered to you or to a third party designated by you who is not the carrier. This also applies to untracked shipments. The procedure for lost parcels is described on the Shipping & delivery page: if a parcel is not delivered, we send a replacement or refund the amount paid.

13.5 We may deliver an order in several parts, at no extra cost to you.

13.6 We do not deliver to excluded destinations, nor to parcel forwarding services used to send products on to an excluded destination.

Article 14 - Payment

14.1 The only payment method in our webshop is bank transfer. After you have confirmed your order, we show you our bank details and also send them by email.

14.2 By choosing bank transfer, you agree to pay in advance. Please transfer the full amount within 7 days after placing your order and state your order reference as the payment reference. We ship your order once your payment has been received.

14.3 If we have not received your payment within 7 days, your order will be cancelled and we will inform you by email. A payment received after cancellation is refunded within 14 days.

14.4 A consumer can never be obliged under general terms and conditions to pay more than 50% of the price in advance (Article 7:26(2) of the Dutch Civil Code). Where advance payment has been agreed, you cannot claim execution of the order before the agreed advance payment has been made.

14.5 Payments from outside the SEPA area may involve bank charges; these are payable by you. The full amount of the order must reach our account.

14.6 Please notify us without delay of any inaccuracies in the payment details provided or stated.

14.7 You receive an invoice stating the VAT once your payment has been processed. It is also available in My account.

Article 15 - Complaints

15.1 Please submit complaints about the execution of the contract fully and clearly described, within a reasonable time after you have discovered the problem, by email to office@hhc-noids.com or through the contact form.

15.2 We answer complaints within 14 days of receipt. If a complaint requires a longer processing time, we will send an acknowledgement of receipt within 14 days, with an indication of when you can expect a more detailed answer.

15.3 If we cannot resolve the complaint together, you can turn to the competent court. We are not affiliated with an alternative dispute resolution body. Consumers living in another EU country can obtain free help with a cross-border complaint from the European Consumer Centre in their country (in the Netherlands: ECC Nederland). Consumers in the Netherlands can find information at ConsuWijzer.

Article 16 - Minimum age and local legality

16.1 We sell exclusively to adults aged 18 or over, or the higher minimum age that applies in the country of delivery. By placing an order, you confirm that you meet this age requirement.

16.2 We ask for your date of birth when you order and may request additional proof of age, such as a copy of an identity document on which you may mask all data except your photo, name and date of birth. If you do not provide the requested proof within 7 days, we may cancel the order and refund any amount paid.

16.3 You may not pass on products to minors.

16.4 The legal status of cannabinoid products differs per country and can change. We do not ship to the excluded destinations listed on the Shipping & delivery page and on each product page. You are responsible for checking, before ordering, that the purchase, import, possession and use of the products are permitted at the delivery address. By placing an order, you confirm that this is the case.

16.5 Orders for an excluded destination are cancelled and refunded in accordance with Article 5.3.

16.6 If authorities in the destination country seize or destroy a parcel because the products are not permitted there, this is at the customer's risk and we are not obliged to send a replacement or refund, unless the seizure results from an error on our part, such as shipping to an excluded destination.

16.7 Any information we provide about the legal status of products is general in nature and is not legal advice.

Article 17 - Liability

17.1 Our liability for damage caused by a failure attributable to us is governed by the law.

17.2 We are not liable for damage resulting from: (a) use of a product contrary to the instructions or warnings, or for a purpose for which it is not intended (for example oral consumption of products not intended for that purpose); (b) the customer's failure to comply with the rules in the country of delivery (Article 16); or (c) incorrect or incomplete information provided by the customer, such as an incorrect address or date of birth.

17.3 If you are a business customer, our total liability is limited to the invoice amount of the order concerned, and we are not liable for indirect damage, except in the case of intent or deliberate recklessness on our part.

17.4 Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, such as liability for death or personal injury, liability under product liability rules, or liability for intent or deliberate recklessness.

Article 18 - Force majeure

18.1 We are not obliged to fulfil an obligation if we are prevented from doing so by circumstances beyond our control, such as disruptions at carriers, strikes, natural disasters, epidemics, government measures, changes in legislation that make delivery unlawful, cyber attacks or power failures.

18.2 During force majeure our obligations are suspended. If the force majeure lasts longer than 30 days, both parties may dissolve the contract without being liable for damages. Amounts already paid for products not delivered are refunded within 14 days.

Article 19 - Personal data

We process personal data in accordance with our Privacy policy.

Article 20 - Applicable law and competent court

20.1 These terms and all contracts with us are governed by Dutch law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

20.2 If you are a consumer with your habitual residence in another country, the choice of Dutch law does not deprive you of the protection of the mandatory provisions of the law of that country.

20.3 Disputes are submitted to the competent court in the Netherlands as determined by law. As a consumer, you may also bring proceedings before the court of your place of residence where the law allows this, and we can only bring proceedings against you before the courts of the country where you live.

Article 21 - Amendments

We may amend these terms. The version in force at the time you placed your order applies to that order. Amended terms are published in the webshop with a new date.
